The General Council of the Spanish Legal Profession is holding conversations with both the acting Government and different political groups to urge legislators to explore the route of the gateway to the RETA proposed by mutual lawyers who regret that the annuity that they will remain after decades of working will not allow them to have a decent pension.
It is about materializing the demand approved in the plenary session last June in relation to alternative mutualists whose contributions will provide them with pensions far from the minimum amount that pensioners under the Special Regime for Self-Employed Workers (RETA) will receive.
The Council approved in the aforementioned plenary meeting to demand from Social Security that all lawyers who have complied with the law in their contributions to the Legal Profession Mutuality receive at least the amount of the minimum pensions that those who have been covered by the RETA will receive . charged to the State budget. According to a statement from the CGAE, "work continues to make effective the demand that professionals who contributed to Social Security can make it compatible to continue practicing with the collection of their pension , just as alternative mutual members can do."
The dean of ICAM, Eugenio Ribón, delivered two days ago to the Congress of Deputies and the Madrid Assembly two NLP proposals that would contemplate the gateway to the RETA for mutual lawyers, as well as fair tax treatment, a guaranteed minimum pension and an improvement in the conditions of those partially retired lawyers.
The Council adds that "these actions are the result of the agreement endorsed by the Plenary Council itself at its meeting on August 25 , in which the councilors showed their conviction Fax Lists about the importance of carrying out unanimous and coordinated action on the claims." of the profession through the representative bodies of the institution. The Permanent Commission understands that this way of proceeding is not only the most responsible, but also the most effective, which is why it rejects those isolated actions aimed solely at assuming an individual media role, which almost always hinder institutional negotiations and end up damaging to the entire profession.
Furthermore, the Council has proposed to continue with the necessary actions so that the Right of Defense Law is included in the first regulatory package to be undertaken when legislative activity begins to take place in Parliament.
Likewise, conversations have continued with the political groups to make them aware of the urgency of incorporating into the remunerations of the Office Shift and Free Justice those assumptions not yet contemplated in some of the territories, mainly in the one managed by the Ministry of Justice, but also in some others. Specifically, the objective is, firstly, to prevent legal professionals from continuing to assume the defense of legal entities without compensation, and, secondly, to ensure that administrations pay for the work carried out by lawyers in cases in which that finally the benefit of Free Justice is rejected.
